IF YOU DON’T AGREE DON’T RIDE. _____1.I ACKNOWLEDGE AND UNDERSTAND THAT WILD RIDE MOTOCROSS & QUAD TRACK DOES NOT CARRY RIDER MEDICAL, LIABILTY, DAMAGE OR THEFT INSURANCE. IF YOU DO NOT HAVE YOUR OWN ADEQUATE COVERAGE WE RECOMMEND THAT YOU DO NOT RIDE. ALL PERSONS ENTERING THE RIDING TRACK ARE REQUIRED TO SIGN THIS LIABILITY RELEASE FORM. ALL PERSONS UNDER THE AGE OF 18 NEED A PARENT OR LEGAL GUARDIAN TO SIGN ON THEIR BEHALF AND THE PARENT/GURDIAN MUST BE PRESENT AT ALL TIME. QUAD RIDERS WILL NEED THEIR DRIVER'S LICENSE TO VERIFY THEIR AGE / ELIGIBILITY(UNLESS PARENT IS PRESENT TO SIGN RELEASE WHICH THEY MUST IF YOU ARE VISITING THE TRACK TO RIDE AND ARE UNDER 18 YEARS OLD). IF YOU REFUSE TO SIGN THE RELEASE YOU WILL NOT BE PERMITTED TO ENTER PROPERTY. _____ 2. ALL RIDERS MUST BE REGISTERED BEFORE THEY RIDE (THIS APPLIES TO EVERY RIDER). IF YOU ARE CAUGHT RIDING WITHOUT REGISTERING FIRST - YOU, AND YOUR BIKE, WILL LEAVE PROPERTY. _____ 3. ALL RIDERS ARE REQUIRED TO WEAR A D.O.T. APPROVED / SNELL CERTIFIED OFF-ROAD MOTORCYCLE HELMET, GOGGLES / EYE PROTECTION, A LONG-SLEEVE JERSEY, RIDING GLOVES, AND BOOTS. IF YOU ARE CAUGHT RIDING WITHOUT THE APPROPRIATE SAFETY GEAR YOU BECOME A SPECTATOR. WEARING ADDITIONAL GEAR, SUCH AS A CHEST PROTECTOR, KIDNEY BELT, RIDING PANTS, ETC.IS RECOMENDED _____ 4. ALL RIDERS ARE REQUIRED TO RIDE WELL-MAINTAINED MACHINERY. ANY BIKE, OR QUAD THAT FAILS A RANDOM INSPECTION WILL NOT BE PERMITTED ON THE TRACK.NURF BARS AND TEATHER SWITCH. _____ 5. INAPPROPRIATE CONDUCT ON THE PART OF A RIDER, SPECTATOR, OR ANY MEMBER OF THEIR FAMILY AND / OR PIT CREW WILL NOT BE TOLERATED. VIOLATORS, AND ALL PARTIES ASSOCIATED WITH THEM, WILL BE ASKED TO LEAVE OR ARRESTED. INAPPROPRIATE BEHAVIOR INCLUDES ANY DEROGATORY, HOSTILE, OBSCENE, PORNOGRAPHIC, OR UNLAWFUL ACT THAT IS DIRECTED TOWARD A MEMBER OF OUR STAFF, A SPECTATOR, ONE OF OUR RIDERS, OR ANY OTHER GUEST. _____ 6. NO PLAY RIDING IN ANY AREA! RIDE SLOWLY AND CAUTIOUSLY TO / FROM THE TRACK (5MPH MAX.). IF YOU ARE CAUGHT PLAY RIDING OR SPEEDING IN A PARKING / PIT AREA YOU BECOME A SPECTATOR. VIOLATORS THAT INJURE SOMEONE WILL BE BANNED FROM RIDING. _____ 7. NO DUMPING OF ANY KIND IS PERMITTED ON THE PROPERTY. IF YOU ARE CAUGHT ILLEGALLY HANDLING/DUMPING ANYTHING, YOU COULD FACE CRIMINAL CHARGES AND WILL BE BANNED FROM THE TRACK. THIS INCLUDES ALL PETROLEUM-BASED PRODUCTS (FUELS, OILS, ETC.), ANTI-FREEZE, TRASH, RV WASTE, AND OTHER ITEMS. _____ 8. NO BONFIRES OR PYROTECHNICS (FIREWORKS) ARE PERMITTED. IF YOU VIOLATE ANY OF THE RULES YOU WILL LOSE YOUR CAMPING PRIVILEGES AND HAVE TO LEAVE. _____ 9. NO ROAMING DOGS ALLOWED. ALL DOGS ARE REQUIRED TO BE ON A LEASH/MUZZLED KEPT AT TRAILER SITE AND/OR CAMP SITE. IF YOU ARE UNABLE TO CONTROL YOUR ANIMAL YOU SHOULD LEAVE IT AT HOME. _____ 10. VENDING AND/OR MERCHANDISING (OF ANY KIND) WITHOUT PERMISSION IS PROHIBITED. IF YOU ARE CAUGHT SELLING ANYTHING WITHOUT A VALID PERMIT YOU WILL BE ASKED TO LEAVE. ANYONE WISHING TO BECOME A WILD RIDE TRACK VENDOR MUST CALL 814-762-6442 AND REQUEST A VENDING PERMIT. ______11.BY SIGNING THIS DOCUMENT I/WE ACKNOWLEDGE THAT I HAVE READ BOTH SIDES AND AGREE TO ABIDE BY THE RULES AND TO HOLD HARMLESS OWNER(S) OF WILDRIDE AND ANY PERSON(S) WORKING FOR THE TRACK FOR ANY DAMAGES OF ANY KIND TO MYSELF AND OR EQUIPMENT THAT MAY OCCUR DURING MY USE AND TIME SPENT A LOCATION OF WILDRIDE PRACTICE TRACK PROPERTY. Initials indicate acceptance of the terms of agreement as listed above. 12. NO ONE EXCEPT AUTHORIZED PERSONNEL AND PARTICIPANTS ARE ALLOWED TO BE ON THE TRACK. Track Liability & Damage Release Form IN CONSIDERATION of being permitted to compete, being a spectator, officiate, observe, work for, or participate in any way in the EVENT(S) or being permitted to enter for any purpose, the property or premises, or any RESTRICTED AREA EACH OF THE UNDERSIGNED, for himself or herself, his or her personal representatives, heirs, assigns or next of kin: ________1) Acknowledges, agrees and represents that he or she has or will immediately upon entering any AREAS, and will continuously thereafter, inspect the ALL AREAS which he or she enters, and he or she further agrees and warrants that, if at any time, he or she is in or about ANY AREAS and he or she feels anything to be unsafe, he or she will immediately advise the officials of such and if necessary will leave the AREA and/or refuse to participate further in the EVENT(S). ________2) HEREBY RELEASES, WAIVES,DISCHARGES AND COVENANTS NOT TO SUE the promoters, participants, racing associations, sanctioning organizations, or any subdivision thereof, club operators, club owner or members, track operators, track owners, officials, car owners, drivers, pit crews, rescue personnel, any persons in any RESTRICTED AREAS, promoters, sponsors, advertisers, owners and lessees of premises used to conduct the EVENT(S), premises and event inspectors, surveyors, underwriters, consultants and others who give recommendations, directions or instructions or engage in risk evaluation or loss control activities regarding the premises or EVENT(S) and each of them, their directors, officers, agents and employees, all for the purposes herein referred to as "RELEASEES", FROM ALL THE LIABILITY TO THE UNDERSIGNED, his personal representatives, assigns, heirs and next of kin FOR ANY AND ALL LOSS OR DAMAGE, AND ANY CLAIM OR DEMANDS THEREFOR ON ACCOUNT OF INJURY TO THE PERSON OR PROPERTY OR RESULTING IN DEATH OF THE UNDERSIGNED ARISING OUT OF OR RELATED TO THE EVENT(S), WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE. ________3) HEREBY AGREES TO INDEMNIFY AND SAVE AND HOLD HARMLESS the Releases and each of them FROM ANY LOSS, LIABILITY, DAMAGE, OR COST they may incur arising out of or related to the EVENT(S) WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE. ________4) HEREBY ASSUMES FULL RESPONSIBILITY FOR ANY RISK OF BODILY INJURY, DEATH OR PROPERTY DAMAGE arising out of or related to the EVENT(S) whether caused by the NEGLIGENCE OF RELEASEES or otherwise. ________5) HEREBY acknowledges that THE ACTIVITIES OF THE EVENT(S) ARE VERY DANGEROUS and involve the risk of serious injury and/or death and/or property damage. Each of THE UNDERSIGNED, also expressly acknowledges that INJURIES RECEIVED MAY BE COMPOUNDED OR INCREASED BY NEGLIGENT RESCUE OPERATIONS OR PROCEDURES BY THE RELEASEES. ________6) HEREBY agrees that this Release and Waiver of Liability, Assumption of Risk and Indemnity Agreement extends to all acts of negligence by the Releases, INCLUDING NEGLIGENT RESCUE OPERATIONS and is intended to be as broad and inclusive as is permitted by the laws of the Province or State in which the EVENT(S) is/are conducted and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. ________7) IF, DESPITE THIS RELEASE, I OR ANY ONE ON MY BEHALF MAKES A CLAIM AGAINST ANY PERSON OR ENTITY NAMED ABOVE, I agree that the disputes, suits or demands, If they arise, will be handled by an arbitration board, not in a court of law, and the decision of the arbitrator(s) shall be binding. I further agree that should the arbitrator(s) decide against me that I will be fully responsible for any and all cost incurred by WILDRIDE MOTOCROS &QUAD TRACK OR ITS OWNER(S) ,PARTNERS and all related entities or employees, members, owners, agents or assigns of the same, including but not limited to attorney fees, travel and expenses, loss of income, etc. I fully understand that by signing this document that I knowingly and willingly waive my right to a jury trial.
